DMCA Policy

At Philtranco News, we respect the intellectual property rights of others and expect our users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that meet the requirements of the DMCA.

Filing a DMCA Notice of Alleged Infringement

If you believe that your copyrighted work has been used on our site in a way that constitutes copyright infringement, please submit a written DMCA Notice to our designated copyright agent. The notice must include the following details:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by the same notice, provide a representative list.
  3. Identification of the infringing material and its location on our website. Please provide sufficient information to help us locate the material.
  4. Contact information including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid DMCA Notice:

  • Philtranco News will remove or disable access to the allegedly infringing material.
  • We will notify the alleged infringer and provide them with a copy of the notice.
  • We will take reasonable steps to notify the user that their content has been removed or disabled.

Counter-Notice

If you believe your content was removed or disabled due to a mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and its prior location.
  3. A statement that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification.
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in your district and agree to accept service of process from the person who submitted the original DMCA notice.

Upon receipt of a counter-notice, we will:

  • Forward it to the original complainant.
  • Inform them that the removed content may be restored within 10-14 business days unless they file a legal action to prevent it.

Repeat Infringers

Philtranco News reserves the right to terminate accounts of users who are determined to be repeat infringers. Users who have been notified of infringing activity more than twice and/or had their content removed multiple times may have their accounts terminated without notice.
